Acceptance of Terms

By accessing and using the services provided by SecurityAuditor S.L. ("we", "our", or "us"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use our services. These terms apply to all users of our personal training services, website, and related services.

Service Description

SecurityAuditor provides personal training services including but not limited to one-on-one training sessions, group fitness classes, nutritional guidance, fitness assessments, and online coaching. All services are provided by qualified fitness professionals in accordance with industry standards and best practices.

User Obligations

By using our services, you agree to:

• Provide accurate and complete health and fitness information
• Follow safety guidelines and instructions provided by our trainers
• Inform us of any changes to your health status or medical conditions
• Arrive punctually for scheduled training sessions
• Provide at least 24 hours notice for session cancellations
• Treat our staff and facilities with respect
• Pay all fees and charges in accordance with our payment terms
• Not use our services for any unlawful or prohibited purposes

Health and Safety

You acknowledge that physical exercise involves inherent risks and that you participate in our training programmes at your own risk. You represent that you are in good physical condition and have no medical conditions that would prevent safe participation in exercise activities. We strongly recommend consulting with a healthcare provider before beginning any fitness programme.

Payment Terms

Payment for services is due at the time of booking unless otherwise agreed in writing. We accept various payment methods as specified during booking. Prices are subject to change with reasonable notice. Refunds are provided in accordance with our cancellation policy. Late payment may result in suspension of services and additional charges.

Cancellation and Refund Policy

Training sessions must be cancelled with at least 24 hours notice to avoid charges. Sessions cancelled with less than 24 hours notice will be charged at full rate. Package refunds are available within 14 days of purchase, subject to a reasonable usage policy. Emergency cancellations due to illness or injury will be considered on a case-by-case basis.

Intellectual Property

All content provided by SecurityAuditor, including training programmes, written materials, videos, and other resources, is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without express written permission. The SecurityAuditor name, logo, and all related marks are trademarks of SecurityAuditor S.L.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, SecurityAuditor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of our services. Our total liability for any claims arising from or related to our services shall not exceed the amount you paid for the specific service giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless SecurityAuditor, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising from your violation of these terms or your use of our services.

Force Majeure

SecurityAuditor shall not be liable for any failure or delay in performance under these terms which is due to fire, flood, earthquake, pandemic, government action, war, terrorism, or other causes beyond our reasonable control. In such circumstances, we will make reasonable efforts to provide alternative arrangements or reschedule services.

Governing Law

These terms shall be governed by and construed in accordance with the laws of Spain. Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of Bilbao, Spain. If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the new terms. We recommend reviewing these terms periodically to stay informed of any updates.

Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including if you breach these terms. Upon termination, your right to use our services will cease immediately. Termination does not affect any rights or obligations that accrued prior to termination. You may terminate your relationship with us at any time by discontinuing use of our services.

Severability

If any provision of these terms is held to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be struck and the remaining provisions shall remain enforceable. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

Entire Agreement

These terms constitute the entire agreement between you and SecurityAuditor regarding our services and supersede all prior and contemporaneous agreements, proposals, or representations, whether written or oral, concerning the subject matter herein.
